摘要
歧視常被用於指稱社會上不公不義的事件或是行動,也有許多人在遇到權利侵害時,會直接聯想到歧視。但似乎在台灣社會中對歧視的理解相當分歧,也很少針對歧視進行討論。而歧視也時常被理解為一種個人的惡習,卻忽略社會文化以及政治因素的蘊含。
本文試圖釐清歧視的概念,了解在什麼樣的情況下、什麼樣的行動可以被稱之為一個「歧視性的行動」。並以Moreau的審議式自由為核心進行討論,其中我們可以知道自主性與發聲權是避免被歧視很重要的關鍵。同時也以同性婚姻法制化過程為例,探討反對同性婚姻法制化是否為一種歧視。

Abstract
The word "discrimination" is often use when describing unfairly events or actions. Most of the people will be connected to discrimination when their rights are violated. However, it seems that the meaning of discrimination is rather different and barely been discussed in Taiwan. Also, discrimination is mostly understood as personal vice, the ignorance of implications, and political factors among the culture itself.
This paper attempts to clarify the concept of discrimination by what type of behavior under what kind of circumstances is identified as a discriminatory action. Moreau`s–“deliberative freedom” demonstrates that anti-discriminatory policies can explain why autonomy and power of speech are important to avoid us for being discriminated. And before the conclusion, an issue of same-sex marriage discourses in Taiwan will be bring up as an example, explaining why the arguments against the same-sex marriage does imply discrimination.
